Course Content

• Overview of Alternative Dispute Resolution processes
• Principles and stages of mediation
• The role of the mediator
• Managing behaviours and emotions in conflict
• Understanding and managing emotions
• Working with attorneys and parties' representatives
• Mediation skills, including: interest-based mediation, active listening, reframing, addressing barriers to agreement, overcoming impasses, and drafting settlement agreements
• Ethical issues, including: confidentiality, neutrality and impartiality, informed consent, conflict of interest, and responsibilities to 3rd parties
